A Supreme Court precedent: potential bidder also has a standing in a tender process

The Israeli Supreme Court issued a precedent-setting ruling, which determines for the first time ever that also a potential bidder, who has chosen not to participate in a tender, has a standing, enabling to “attack” the tender and to review its documents.

This is a significant novelty in the Israeli tender law practice, due to the fact that until now, in general, a standing was given to the bidders that participated in the tender and submitted an offer, and not to a “public petitioner”.
