Partners Joseph Benkel and Chen Nusel, associate Edya Weltman and intern Eyal Dayan – successfully represented CAF Investment Projects SA and Shapir engineering Ltd, in an administrative petition filed by Eged Holdings Ltd and שיכון ובינוי – Shikun & Binui Ltd, seeking to disqualify Shapir & CAF from participating in a tender for the construction, financing, operation and maintenance of the blue light rail line in Jerusalem – an estimated 10 billion NIS project.
In the framework of the petition, Eged and Shikun claimed for unfair competition, due to the fact that Shapir & CAF, as the owners of the current concessionaire of the red and green line project in Jerusalem, allegedly hold unfair advantages and therefore, should be disqualified from participating in the tender.
The court rejected all Eged and Shikun’s arguments and fully rejected the administrative petition.
