Representation of Agrometal Projects Ltd. in their motion to appeal to the Israeli Supreme Court

Partner Ofer Larisch, Associates Eti Nudelman Alini and Gal Rabinovich, and intern Larin Hason, successfully represented Agrometal Projects Ltd. in their motion to appeal to the Israeli Supreme Court regarding the District Court in Beer Sheva’s decision to not allow Agrometal to present to a court-appointed expert documents that supported its cause in a case.

The reason for the original decision that did not allow Agrometal to present its side was the timing for the request and that it would delay the hearing of the case.

The Judge, Ruth Ronen, of the Supreme Court accepted Agrometal’s motion to appeal, as well as the appeal itself. The court ruled that the lower court’s decision resulted in lack of equality between the two sides which goes against the basic concept of civil law. Furthermore, the court held that this inequality needs to be avoided so that one side is not at an advantage over the other side.
