
Partner Eli Cohen represented Mekorot in a precedent-setting ruling handed by the Supreme Court decision. For the first time, The Supreme Court decided that the correct way to submit a claim regarding excessive water payments is to file an appeal to the water court. If the appeal is accepted, it will be possible to file a civil lawsuit in the civil courts. This decision has far-reaching consequences because similar suits that have been submitted to the civil courts can no longer be accepted before submitting an appeal to the water courts, and as a result, it is expected that the existing claims filed to civil courts will be dismissed.
