Partners Hillel Ish-Shalom and Roy Kubovsky, and Associate Mor Weiss represented S. Schestowitz. in two requests for class action certification that were consolidated for a combined total of hundreds of millions of NIS.
The motions, filed in 2017, alleged that S. Schestowitz marketed insects’ infested “Barila” brand pasta products, due to defective packaging and / or poor storage of products, and / or failure to provide instructions as required regarding the due storage of the products.
The Honorable Judge Y. Keinar, of the Central District Court, handed down a reasoned and lengthy judgment in which he declined the two motions and held, inter alia, that the evidence presented by the applicants did not reach the evidentiary threshold required, and that the motions included various material defects
