The golden rule of inheritance law is to fulfill the deceased’s last desires, as expressed in their will. However, there are cases in which the desires of the deceased aren’t clear as their will was created when they were already dependent on family members, including their spouse, which influenced their decisions and wishes. The Family Court has decided that in situations such as these, even if the will is legally acceptable, the situation means that the document did not express their true desires. The health condition, dependence on others, and other issues mean that the will is invalid.
In a hearing held at the District Court in Jerusalem, Shiri Malca represented our clients in a complicated inheritance case that has been ongoing for ten years. The Court rejected the appeal that was filed against our clients and supported and approved the Family Court’s decision.
